State Sued for Failure to Provide Home Care

The state’s Family and Social Services Administration (FSSA) has been sued by citizens from northwest Indiana for its failure to provide alternatives to nursing home care as required under the civil rights provisions of the Americans with Disabilities Act (ADA). The suit alleges that the state of Indiana’s failure to properly fund alternatives to nursing homes puts people at risk of being forced into nursing homes. CAC is reviewing this case and may join it in some capacity.

According to CAC’s John Cardwell, "For over three years CAC, AARP, United Senior Action and other organizations have negotiated with FSSA, at the Governor’s request, to seek ways to use more Medicaid dollars for home and community based long term care. In fact, CAC deeply appreciates Governor O’Bannon’s long standing support of home care and other long term care alternatives. However, three years is long enough to wait. During that time thousands of Hoosiers have been forced involuntarily to use nursing homes because sufficient affordable home care services have not been available. It is time for action by the administration."
