IURC Grants CAC Petition on Rehearing in AES Rate Case

INDIANAPOLIS — The Indiana Utility Regulatory Commission has granted Citizens Action Coalition of Indiana’s (“CAC”) request for rehearing concerning two major developments that occurred after the evidentiary record closed in AES Indiana’s rate case, Cause Number 46258: the proposed Google Monrovia data center and the announced acquisition of The AES Corporation by a BlackRock-led consortium*.
CAC raised these developments because they could materially affect AES Indiana’s infrastructure investments, customer cost allocation, financial outlook, cost of capital, and more — issues that were central to the Commission’s determination of just and reasonable rates.
Google’s Monrovia data center is particularly significant because AES Indiana denied that a large data center customer was imminent and that any resulting issues would be addressed in future proceedings. AES Indiana subsequently filed IURC Cause No. 46394 seeking approval of agreements and substantial infrastructure investments to serve Google’s Monrovia data center. CAC learned in that case that AES Indiana had executed one agreement with Google more than a week before filing rebuttal testimony in its rate case and another agreement nearly a month before the start of the evidentiary hearing in the rate case. Yet, at no time did AES Indiana file a correction to sworn testimony or supplement responses to CAC data requests.
At the same time, the announced BlackRock-led acquisition of AES represents a significant change in the company’s ownership and financial circumstances that was not before the Commission when it issued its June 2026 rate order.
“We are pleased that the Commission recognized that these developments warrant a very close look,” said CAC Program Director Ben Inskeep. “The Commission should not lock Indiana ratepayers into long-term rates based on an outdated picture of AES Indiana’s customers, investment needs, and financial circumstances.”
The Commission’s decision to grant rehearing provides an opportunity to examine these issues in light of the most current circumstances affecting AES Indiana and its customers.
